What Is German Legal Insurance & Why Do You Need It?

When relocating to Germany, it is important to understand the basics of German legal insurance and why you need it.

It seems like every week there’s a story in the news about someone being sued over a seemingly ridiculous incident. Unfortunately in this day and age things both big and small are often handled in court. There’s no denying that legal disputes are expensive, regardless of whether or not you win or lose the dispute.

At the most basic level, German legal insurance protects you financially from any type of legal dispute brought on by you or against you by another party. Examples of some situations in which legal insurance would be beneficial include:

  • Lawyer fees. You decide to buy a home in Germany, and in the end the seller wants more money than he initially said or how it was written in the contract. Legal insurance would pay for your lawyer’s time.
  • Lawyer fees and court fees. You go to a restaurant for dinner and get salmonella poisoning. As a result, you are in the hospital for 3 days. When you contact the restaurant for answers, the owner denies any wrongdoing. You decide to build a legal case against them to pay for your hospital fees. Without legal insurance you may not have the money to cover the expenses and because of that you wouldn’t even pursue your rights.

What Does German Legal Insurance Cover?

Legal protection can be divided into different sections. Depending on which legal insurance you bought, you will have different coverage.

The most common ones are:

Private Legal Insurance

  • Indemnity legal protection
  • Private Contracts
  • Disputes with administrative authorities

 

Professional Legal Insurance

  • Disputes with your employer
  • Defense in disciplinary and professional conduct cases

 

Traffic Offense Legal Insurance

  • Indemnity legal protection
  • Legal protection in contract and property law (e.g. after buying a car)
  • Misdemeanor legal protection
  • Disputes with financial authorities
  • Disputes with administrative authorities
  • Criminal legal protection
  • Parking violations
  • Driving of external vehicles through insured persons

 

Renters Legal Insurance (additional)

  • Disputes with your landlord
  • Disputes with neighbors

 

The first three (private, professional & traffic legal insurance) are often offered as a package, because they are all important and legal cases often happen in those areas.

This coverage also usually extends to your children, and covers legal fees worldwide (limited), rather than only in Germany.

What Isn’t Covered With German Legal Insurance?

Although you might think this is obvious, the most important thing to know is that no legal insurance covers the penalty you might get in the end because you e.g. drove too fast and got a fine.

Legal insurance will cover the legal costs (court costs, attorney, witnesses) if you go to court because you think you didn’t go to fast or because there was no proper sign etc. But if you lose, you still have to pay the penalty for what you did wrong yourself.

Most Germans think that legal insurance would cover this. But if that were the case, everybody could do whatever they wanted because the legal insurance would pay the penalty of their offenses. That doesn’t really make sense, right?

Another thing is the “deductible”. This is a variable amount of money you still have to pay yourself for any legal case that e.g. goes to court. The deductible costs on average a couple hundred euros (most of the time 150€ or 300€).

Costs Without German Legal Insurance

  • Good legal insurance offers a “free initial consultation”. Without that you could end up paying a couple hundred euros (depending on your lawyer).
  • Any court or lawyer fees incurred when you go to court to press charges or pursue your rights will cost a couple thousand euros from the start. If you win, the other side has to cover those costs. But if you lose, your legal insurance bears the expenses. Legal insurance makes your situation so much easier because you know that even if you lose your case you don’t have to pay 2.000€, 3.000€ or 5.000€ in court and lawyer fees. Your legal insurance incurs the costs.
